A. Cancellation Policy
Introduction
Consumers have a right of withdrawal under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.
Right of Withdrawal
You have the right to cancel this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the last item.
To exercise your right of withdrawal, you must inform us (Vladimir Joffe, Hoofstar, Griemstieg 5, 22885 Barsbüttel, Germany, Tel.: +49 (0) 151 55 84 03 81, Email: klebebeschlag@hoofstar.com) of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent by post or email). You may use the attached sample cancellation form, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for any additional costs arising from your choice of a different type of delivery than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract.
For this reimbursement, we will use the same means of payment that you used in the original transaction unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires.
You will bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods if this loss in value results from handling that was not necessary to examine the nature, characteristics, and functioning of the goods.
Exclusion or Premature Expiry of the Right of Withdrawal
The right of withdrawal does not apply to consumers who, at the time of concluding the contract, do not belong to a member state of the European Union and whose sole residence and delivery address are outside the European Union at the time of concluding the contract.
Linked/Financed Transactions
If you finance this contract with a loan and later withdraw from it, you are also no longer bound by the loan agreement, provided that both contracts form an economic unit. This is particularly the case if we are also your lender or if your lender relies on our cooperation regarding financing.
If the loan has already been disbursed to us when the withdrawal takes effect or when the goods are returned, your lender assumes our rights and obligations from the financed contract in relation to you concerning the legal consequences of withdrawal or return. The latter does not apply if the subject of this contract is the acquisition of financial instruments (e.g., securities, foreign exchange, or derivatives).
If you want to avoid a contractual commitment as far as possible, make use of your right of withdrawal and also withdraw from the loan agreement if you are entitled to do so.
General Notes
- Please avoid damaging or contaminating the goods. If possible, return the goods in their original packaging with all accessories and all packaging components. If necessary, use a protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
- Please do not return the goods to us freight collect.
- Please note that the above points (1-2) are not a prerequisite for the effective exercise of the right of withdrawal.
